La transición española a la democracia tuvo como hito fundamental la elaboración de un texto constitucional, fruto del consenso entre todos los partidos democráticos. La Constitución de 1978 fue aprobada por las cortes en sesiones plenarias del Congreso de los Diputados y del Senado celebradas el 31 de octubre de ese mismo año. Pero para su entrada en vigor fue necesario que el pueblo español la ratificase en referéndum, que se celebró el 6 de diciembre de 1978. En esta votación, sobre un censo de 26.632.180 votos, los votos favorables fueron 15.706.078, produciéndose el 32,8 por ciento de abstenciones. La abstención fue superior al 40 % en las cuatro provincias gallegas, las tres vascas y Tenerife. Sobre el total de votantes, entre el 60 y el 70 % lo hicieron a favor en Guipúzcoa, porcentaje que subió hasta el 80 % en Vizcaya, Alava, Navarra y Palencia. Más del 90 % de los votantes lo hicieron a favor en las provincias canarias, Andalucía, Murcia, Tarragona, Barcelona, Lérida y Huesca. En el resto de la nación ganó el sí con un porcentaje entre el 80 y el 90 % del total de votos. Aprobada en referéndum, la Constitución de 1978 fue sancionada por el rey Juan Carlos ante las Cortes el 27 de diciembre de ese mismo año.
